FUNNY NIGHT! OH MAN WHERE DO I START, THIS ONE GOES DOWN IN MY CB RADIO EXPERIENCE HISTORY BOOK.

So first of all lets just list my contacts for the day.

Renegade - Las Vegas
290 - Temple, TX
210 Star - Central TX
Desert Iguana - Temple, TX
(most of these guys are local, but nevertheless were on the bowl)
Then I had a few decent receptions that I just couldn't remember including a few skippers from New York, Illinois, and California.

So the afternoon died down and I went to hang out with some buds. Was my 20th birthday so we farted around... Come 11 we went out to this field that I hang out in for radio. Crop field with a big old hill in it, good spot for reception.
I'm yakkin away with some of the locals, having a good old time when 2 police cars pull up. They want to know what I'm doing, so after they make all of us get out of the car, hands on hood, search us, search the vehicle (I had nothin to hide!) they tell us there are some burglars on the run within a 3 mile area of us. They think we're the guys.... Well, we're all
nerd-types, glasses, dorky looking. After a few minutes, they figure out we aren't the people they are looking for...

The police radio rings out "2236, we've got 3 males out here SHOOTING SOME KIND OF A BEAM OFF OF A CB RADIO"
"Unit ###, some kind of beam? Repeat."
"2236, they're shooting some kind of beam"
"Unit ##, roger on the beam."

Then you hear another person come on

"Unit ###, did you say beam? What are you talking about?"

It just went on and on.. I tried to explain to them I was just seeing if I might get lucky and pick up any skip at night, and we were just relaxing having a night out in the country. Before it was all said and done the officer said "I don't know what the hell you're talking about and I don't think it has anything to do with a burglary..." and he lets us follow him out so we can get through the police roadblocks without getting carded again..

I busted out laughing so hard.... I'm still laughing right now... If I had a camera I would have taken a picture on the guy's face.....

Lol, no the idea of the story was.

They were saying -I- was 'shooting some kind of BEAM."

They couldn't comprehend what 'skip' was and the officer keps saying 'beam.'

The owner of the land I was on filed a complaint with the county saying they had no reason to harass anyone on his property.

It is funny how people can take something you say and confuse themselves even more. I've been stopped a few times over the years or approached while talking in fields, parking lots, participating in fox hunts, etc. and usually just tell them I'm a ham (and I am) and that I'm participating in an emergency preparedness deal or something. I'm clean cut and carry my license card. The only reason I would go to that extreme is to keep them from tossing the car for more contraband, like beer or whatever. I've never had one that knew enough about radio to ever question an amp or anything. Always be polite, and they are on their way unless you're really asking for it. My most recent stop was on a dirt road leading to a field that I like to talk from, with good elevation and low noise floor. It is an old county road that I didn't realize had just been marked "no through traffic". I rolled around a curve and there he was, johnny law, with another victim. The victim waved at me and said "I think he wants to talk to you". I pulled over and stuck my open beer in the console and hid the remaining 3 unopened of my newly acquired 6 pack under the seat. This was all in minimal motions, as I have no window tint. My vehicle was clean, no tint, and when he looked into it, I didn't have any extra junk in there, which was good, since I could have easily been searched and gotten at minimum an open container deal. I then overheard johnny telling the victim that this road has been shut down because of a high level of drug deals taking place there. I then felt the lady might be making up something about me, but she wasn't. He ran my stuff and told me about the signs. He was nice enough to tell me that I could go through there, but that I should be prepared to get stopped every time. That was my favorite shortcut, complete with natural restrooms, hidden from the traffic, a virtual paradise within the city, and it shaved 10 minutes off my daily commute dropping the kid off at the nanny, but thanks to the drug pushers it's off limits. -drdx

No, it was only about 4 in the afternoon, so it was only after a couple, and it was a pack of those 8 oz. ones that are only $3.49. I love those little cans. I can put one in the console if I have to, and a whole six pack of them will fit UNDER my kids booster seat in the molded plastic voids underneath it. They're great for when you go to the store and buy a real case of beer and don't want to break into it until you get home. That, and if you only have 5 dollars on you, you can get one of those 6 packs and a giant slim jim. Now that's quality driving and dining. And, in true southern form, it's not a true slim jim experience untill you use the wrapper to floss with. -drdx

The land owner knew the people on his land. They were not criminals. They didn't even match the suspect description.

If it were my land, I probably would have filed a complaint as well. If the police were in pursuit of the criminal suspect and he entered my property, by all means, apprehend him. However, I'll take care of my land, and if there's a problem, I'll call in the law. Don't come onto my land to harass myself or my friends (none of which match the description of the suspects) because a (insert violation here) occurred within the 5-mile area. They had no cause to request a search of Bigfoot's vehicle, and Bigfoot- you had no requirement to submit. If the law ever asks you if they can search your person or your vehicle or your home, the correct answer is always *NO*. Don't give a reason, or say anything other than "no" or "i do not consent to search." If they see something that gives them probable cause, they can still search you... but even if you have nothing to hide- the answer is *****NO*****.

Trust me on this one. You can't get in trouble for refusing a search. You can get in trouble if you permit a search and they find something ridiculous like your filet knife that fell under the seat after your last fishing trip. You are not a criminal, your rights protect you in this. It doesn't mean you "have something to hide" or that you're "an idiot". The same holds true for the law coming onto the land to harass you when you don't even match the suspect description. The land owner doesn't want to be unreasonably harassed, or have his guests unreasonably harassed. It's not too much to ask for... it's the law.

True...You don't have to let them search you, or your car....But! "If" they then think you maybe hiding something by saying "NO", then all they have to do, is hold you till a supervisor shows up with a warrant, and then you can bet they are going to give you the third-degree of a search! So what could be a matter of a few minutes of being "Harassed by the Man" could turn into a few hour's!

As for the cops driving around in the guys field, it doesn't mater if they had permission from the farmer (or owner) or not...They were searching for burglary suspects, and seen someone late at night out in the middle of a field, of course they are going to investigate!

like my uncle, who is a retired cop says... don't give the officer any carp, because you may beat the rap, but you can't beat the ride.

the filet knife example is real... my pop was pulled over once, and the cop for whatever reason wanted to search the car. pop didn't see any reason to refuse, the cop found a long filet knife tucked under the seat, where it fell to after a recent fishing trip. It was considered a concealed weapon. Having to wait on site an hour or two for a supervisor to deem you're really search-worthy and secure a search warrant is still a better option than to be arrested for something you didn't even think of as a problem, but something they could arrest you for if they wanted. Think about the time it takes to transport, in-process, out-process, expense and time for getting to the impound yard and pay to get your vehicle out of impound, etc. The wait-for-supervisor option is still the better choice.

On the other hand, I can talk my way out of a ticket more than 90% of the time, and that remaining amount I usually manage to get the offense reduced for the citation. I have requested to have my vehicle searched on at least two occasions that I can recall, and my answer was "No." If I was questioned as to my reason for refusing a search, my answer was "I do not consent to a search." The officer looked and looked thru the window, but couldn't find anything to give him probable cause to search, and I was calm and cool... I had nothing to be concerned about. My record checked out, and everything else was in order, and I was sent on my way.

I guess it would really boil down to the cop that stops you...Just hope he's not some crazed Ex-Military reject that thinks everyone is a terrorists, until proved otherwise!

And another way to look at it, would be "If" you said No, and a supervisor was called out with a warrant, and they found the fishing knife, you would still be going to jail, only hour's later!

Way my luck run's, I would say No to some cop that would plant a gun under the seat, just to prove his point, that he thought I was hiding something....

Sometimes ya just can't win for loosing...

I can't remember ever having a cop want to search my vehicle, but if they wanted to, I would probably let them since I'm usually under the impression that most cops are understanding if they run across something like a fishing knife, or a Bazooka hid under the back seat! :D
